silversummit provides restaurant menu performance analytics tools and related services designed to help restaurants optimise their menu performance, pricing strategies, and operational efficiency. Our services include data analytics platforms, reporting tools, consultation services, and related software solutions.
As a user of our services, you agree to use our platform responsibly and in accordance with all applicable laws and regulations. You must provide accurate and complete information when creating accounts or using our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our services. You must not attempt to gain unauthorised access to our systems, networks, or data. You agree not to interfere with or disrupt our services or servers connected to our services.
You are prohibited from using our services to transmit any harmful, offensive, or inappropriate content, including but not limited to malware, spam, or content that infringes on the rights of others.
All content, features, and functionality of our services, including but not limited to text, graphics, logos, images, software, and data compilations, are the exclusive property of silversummit or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use our services for your intended business purposes. This licence does not include any right to reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit our intellectual property without our express written permission.
Any feedback, suggestions, or improvements you provide regarding our services may be used by silversummit without restriction or compensation to you.

To the maximum extent permitted by applicable law, silversummit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
Our total liability to you for all claims arising from or related to these Terms or our services shall not exceed the amount you paid to us for the services in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or completely secure. You acknowledge that your use of our services is at your own risk.
You agree to defend, indemnify, and hold harmless silversummit and our officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.
If you are a consumer residing in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our services will cease immediately.
You may terminate your account at any time by contacting us. Upon termination of your account, we may delete your data in accordance with our data retention policies, subject to any legal obligations to retain certain information.
The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, and governing law.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.
These Terms, together with our Privacy Policy and any additional terms applicable to specific services, constitute the entire agreement between you and silversummit regarding our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
